If you're a consumer in the EEA, we don’t exclude or limit any liability for gross negligence, intent, or death or personal injury caused by our negligence or willful misconduct.
Limitation of liability
We are building the best service we can for you but we can't promise it will be perfect. We're not liable for various things. If you think we are, let's try to work it out like adults.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEBAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD-PARTIES; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. If we cause damage to you and you're a consumer in the EEA, the above doesn’t apply. Instead, our liability will be limited to foreseeable damages arising due to a breach of material contractual obligations typical for this type of contract. We are not liable for damages that result from a non-material breach of any other applicable duty of care. This limitation of liability won’t apply to any statutory liability that cannot be limited, to liability for death or personal injury caused by our negligence or willful misconduct, or if and to exclude our responsibility for something we have specifically promised to you.
Governing law and jurisdiction
If you are a consumer in the EEA, you can sue us in your home courts. Everyone else will come to Estonia.
If you are a consumer in the EEA, this won’t deprive you of any protection you have under the law of the country where you live and access to the courts in that country.
For everyone else - these terms are governed by Estonian law and you and we submit to the exclusive jurisdiction of the Estonian courts in relation to any dispute arising out of or relating to these terms, but we will still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
General terms
If we're making a big change to the terms, we'll let you know. If you don’t like the new terms, please stop using the App.
We reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if that’s what we decide. We may revise these Terms from time to time and the most current version will always be posted on the App. If a revision, in our discretion, is material, we’ll notify you. By continuing to access or use the App after revisions become effective, you agree to be bound by the new Terms. If you don’t agree to the new terms, please stop using the App.
We will tell you if we sell the App.
Either you or us may assign this Agreement, and any rights and licenses granted under it, to a third party. In case of such an assignment by us, you are entitled to terminate the agreement with immediate effect by deleting your account. We will provide you with reasonable notice of any such assignment.
We agree on all Terms and Policies. You can find them all in the Legal section of the App.
These Terms, together with the Privacy Policy, Community guidelines and any additional agreements you may enter into with us shall constitute the entire agreement between you and Gamebay concerning the App. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Privacy Policy
When you use our services, you’re trusting us with your information. We understand this is a big responsibility and work hard to protect your information and put you in control.
This Privacy Policy is meant to help you understand what information we collect, why we collect it, and how you can manage it.
We only collect the information you choose to give us, and we process it with your consent, or on another legal basis, we only require the minimum amount of personal information that is necessary to fulfill the purpose of your interaction with us; we don't sell it to third parties, and we only use it as this Privacy Statement describes.
We are compliant with the General Data Protection Regulation (GDPR).
No matter where you are, where you live, or what your citizenship is, we provide a high standard of privacy protection to all our users around the world, regardless of their country of origin or location.
Please make sure you read and agreed on Terms of Service before reading and agreeing on this Privacy Policy. Definitions from Terms of Service are valid here.
How we collect information
When you give it to us or give us permission to obtain it
When you sign up for or use the App, you give us certain information voluntarily. The initial information you give us (username, password, age) is not your personal information. This is why there is no age limit to the Account creation.
However, once you advance with the Account setup you will give us more information. This includes your email address, phone number, name, address, photo, ID/passport photo, and any other information you give us. You can also choose to share with us location data, photos, videos, and live streams. If you buy something on the App, we collect payment information, contact information (address and phone number) and details of what you bought. If you buy something for someone else on the App, we collect their delivery details and contact information.
If you link your Facebook, Instagram, Google, Youtube, Twitch or other accounts from other third-party services to the App, we also get information from those accounts (such as your friends or contacts). The information we get from those services depends on your settings and their privacy policies, so please check what those are.
We also get technical information when you use the App
Whenever you use any website, mobile application or another internet service, certain information gets created and logged automatically. The same is true when you use our App. Here are some of the types of information we collect:
Log data. When you use our App, our servers record information (“log data”), including information that your browser automatically sends whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes your Internet Protocol address, the address of and activity on websites you visit that incorporate App’s features, searches, browser type and settings, the date and time of your request, how you used App, cookie data and device data.
Cookie data. We also use “cookies” (small text files sent by your computer each time you visit our website, unique to your Account or your browser) or similar technologies to capture log data. When we use cookies or other similar technologies, we use session cookies (that last until you close your browser) or persistent cookies (that last until you or your browser delete them). For example, we use cookies to store your language preferences or other settings so you don‘t have to set them up every time you visit App. Some of the cookies we use are associated with your Account (including information about you, such as the email address you gave us) and other cookies are not. For more detailed information about how we use cookies, please review our Cookies Policy.
Device information. In addition to log data, we collect information about the device you’re using App on, including the type of device, operating system, settings, unique device identifiers and crash data that helps us understand when something breaks. Whether we collect some or all of this information often depends on what type of device you’re using and its settings. For example, different types of information are available depending on whether you’re using a Mac or a PC, or an iPhone or Android phone. To learn more about what information your device makes available to us, please also check the policies of your device manufacturer or software provider.
Our partners and advertisers share information with us
We also get information about you and your activity outside App from our affiliates, advertisers, partners and other third parties we work with, or other publicly available sources.
Online advertisers or third parties share information with us to measure or improve the performance of ads on the App, or to figure out what kinds of ads to show you. This includes information about your visits to an advertiser's site or purchases you made from them, or information about your interests from a third-party service, which we might use to help show you ads.
Why we collect data
We want to show you relevant content, improve your experience in Esports Arenas and in the Friendly Fire community.
We use the information we collect from our App for the following purposes:
- Customizing your App’s experience.
- Improving your experience in Friendly Fire Esports Arenas.
- Showing relevant content.
- Suggesting profiles and tags that are relevant to you.
- Generating revenue from advertisers by showing you relevant content.
- Improving the App and add new features.
- Maintaining a relationship with users.
- Marketing purposes.
- Protecting our users.
- Detecting, preventing, or otherwise addressing fraud, abuse, security, or technical issues with our App.
- Fulfilling obligations to our partners like developers and rights holders.
What we do with the data
In order to accomplish our goals, we use the data we collect to:
- Identify you when you use App, and process your transactions.
Recommend Content based on your activity on the App. For example, if we see you are playing strategy games we may suggest you strategy games related events and news.
- Respond to your questions or comments.
Suggest other people who have similar interests. For example, if you follow shooting games, we may suggest you to follow popular players who play shooting games.
- Help your friends and contacts find you on the App, if you agree to this in your settings. For example, if you sign up using a Facebook account, we can help your Facebook friends find you on the App when they first sign up for the App. Or, people can search for your account on the App using your email.
- Conduct analytics on who is using the App and what they are doing. For example, by logging how often people use two different versions of a feature on the App, we can understand which version is better.
- Improve the App and offer new features.
- Send you updates and news by email or push notification, depending on your settings.
- Work with law enforcement and keep the App safe. We may get requests for account information from law enforcement authorities like the police or courts.
- Decide which ads to show you. For example, if you show interest in competitive gaming, we may show you ads for esports tournaments. We customize the ad content we show you by identifying your interests based on your onsite and offsite activities, as well as by using the information we receive from ad partners or other third-parties. Where we use cookies to identify your offsite interests, we will obtain consent where required as described in more detail below. Where ad partners or other third parties share information with us about you, we rely on the consent they have obtained.
- Tell our ad partners how their ads on the App are doing, and how to make them better. Some of this information is aggregated. For example, we would report to an advertiser that a certain percentage of people who viewed a promoted content went on to visit that advertiser's site. In other instances, this information isn’t aggregated. For example, we would let an advertiser know that a particular promoted content has been saved by certain people.
- Tell our ad partners the types of products you might be interested in. For example, if you create content and play only shooting games, we can tell our ad partner that you are more interested in products that are used for shooting games. This helps us and our ad partners to make sure that the content and ads you see are relevant to you. When we identify your interests based on your offsite behavior with cookies, we will obtain any consent we may need.
Your consent
We’ll only use your information with your consent in order to:
- Send you marketing materials by email, text or push notification, depending on your account or operating system settings. Each time we send you marketing materials, we give you the option to unsubscribe.
- Identify your location and customize the content we show you. For example, if we know that you are located close to newly opened Esports Arena we could send you an event invitation. You can opt-in to this in your device operating system settings.
- Tell our ad partners how their ads are doing using the App’s tags. The App tag (a piece of code) delivers insights to us and our ad partners about actions that a person takes on their website after viewing an ad on the App.
- Identify you across different browser sessions. This means if you log into the App from your phone (or any device), we'll remember that you're you and you won't need to enter your login details each time you visit the App.
- Show you ads you might be interested in. We use cookies to identify your interests based on your offsite behavior. We do this for existing users and for new users, and it helps us customize the new user experience.
To find out more about how we use cookies, and your choices about how we use them, please see our Cookies Policy.
Sharing your information
We do not share your personal information with companies, organizations, or individuals outside of Gamebay. There are a few exceptions:
1. We’ll share personal information outside when we have your explicit consent for every single action. For example, we might ask you if you want to share your birthday with a game publisher that gifts Friendly Fire users for their birthdays.
2. Other services (like Facebook, Instagram, Twitter) when you decide to link your Account to those services or publish your activity on the App to them. For example, you can choose to publish your posts on Instagram.
3. We provide personal information to our affiliates and other trusted businesses or persons to process it in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. For example, Friendly Fire Esports Arena that you visit will have access to some of the information required to give you a service. Another example, we share payment card information with the payment companies we use to store your payment information.
4. We share data with trusted security consultants to help us get better at identifying spam. Some information we acquire may be collected by third party providers on our behalf.
5. Online advertisers and third-party companies that we or they use to audit or improve the delivery and performance of ads or content on websites and apps (for example, through Google Analytics).
6. Our wholly-owned subsidiaries and affiliates. If we were to engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this Policy, we would share your information with a party involved in such a process (for example, a potential purchaser).
7. To enforce applicable Terms of Service, to detect, prevent, or otherwise address fraud, security, or technical issues and to Protect against harm to the rights, property or safety of Gamebay and Friendly Fire Franchise, our users, or the public as required or permitted by law.
8. For law, regulation, legal process, or enforceable governmental request.
Exporting and deleting your info
You can export a copy of the content in your Account if you want to back it up or use it with a service outside of Gamebay. To export your data you need to email your request from your verified email account to gdpr@gamebay.io.
You can delete your Account from the App’s settings. In some cases, we retain data for limited periods when it needs to be kept for legitimate business or legal purposes.
We try to ensure that our services protect information from accidental or malicious deletion. Because of this, there may be delays between when you delete something and when copies are deleted from our active and backup systems.
Compliance
We maintain servers around the world and your information may be processed on servers located outside of the country where you live. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply the same protections described in this policy.
When we receive formal written complaints, we respond by contacting the person who made the complaint. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of your data that we cannot resolve with you directly.
If European Union (EU) data protection law applies to the processing of your information, we provide the controls described in this policy so you can exercise your right to request access to, update, remove, and restrict the processing of your information. You also have the right to object to the processing of your information or export your information to another service.
For users based in the European Economic Area or Switzerland, the data controller responsible for your information is Gamebay OÜ. You can contact the responsible office by emailing gdpr@gamebay.io.
We process your information for the purposes described in this policy, based on the following legal grounds:
1. With your consent. We ask for your agreement to process your information for specific purposes and you have the right to withdraw your consent at any time.
2. When we’re pursuing legitimate interests:
- Customizing your App’s experience.
- Improving your experience in Friendly Fire Esports Arenas.
- Showing relevant content.
- Suggesting profiles and tags that are relevant to you.
- Generating revenue from advertisers by showing you relevant content.
- Improving the App and add new features.
- Maintaining a relationship with users.
- Marketing purposes.
- Protecting our users.
- Detecting, preventing, or otherwise addressing fraud, abuse, security, or technical issues with our App.
- Fulfilling obligations to our partners like developers and rights holders.
3. When we’re complying with legal obligations. We’ll process your data when we have a legal obligation to do so, for example, if we’re responding to the legal process or an enforceable governmental request.
Choices you have about your info
Our goal is to give you simple and meaningful choices regarding your information. If you have the Account, many of the choices you have on the App are built directly into the App or your settings. For example, you can:
- Edit information in your profile at any time, decide whether your profile is available to search engines, or choose whether others can find your account using your email address.
- Decide which information you provide on your profile will be public.
Link or unlink your Account from other services (like Facebook, Google or Twitter).
- Choose whether the App will be customized for you using information from other websites or apps
- Choose whether your purchases on the App will be used to customize recommendations and ads for you
- Close your account at any time.
You also have choices available to you through the device or software you use to access the App. For example:
- The browser you use lets you control cookies or other types of local data storage
- Your mobile device lets you choose how and whether your location, photos, advertising identifiers, and other data is shared with us.
To learn more about these choices, please see the information provided by your device or software provider.
How long we keep your information
We keep your information only so long as we need it to provide the App to you and fulfill the purposes described in this policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we’ll either remove it from our systems or depersonalize it so that we can't identify you.
Our policy on minors’ information
There is no age limit for the App’s basic features. However, for using all features you must meet the following requirements: If you’re based in the EEA, you may only use the App if you are over the age at which you can provide consent to data processing under the laws of your country or if verifiable parental consent for your use of the App has been provided to us. If you are based outside of EEA any use or access by anyone under the age of 13 is not allowed.
If you are a parent and you learn that your child is using the App and you don't want them to, please contact us emailing childprotection@gamebay.io.

Cookies Policy
Our Privacy Policy describes how we collect and use information, and what choices you have. One way we collect information is through the use of a technology called “cookies.” We use cookies for all kinds of things in the App.
Please make sure you read and agreed on Terms of Service before reading and agreeing on this Cookies Policy. Definitions from Terms of Service are valid here.
What's a cookie?
In real life, it’s a delicious baked good. But in technology, a cookie is something completely different. When you go online, you use a program called a “browser” (like Apple’s Safari or Google’s Chrome). Most websites store a small amount of text in the browser - and that text is called a “cookie.”
How we use cookies?
We use cookies for lots of essential things on the App - like helping you log in and tailoring your experience. Here are some specifics on how we use cookies.

What we use cookies for?
Personalization
Cookies help us remember which games, posts, tags or profiles you’ve interacted with so we can show you related content you might like.
We also use cookies to help advertisers show you interesting ads. For example, if you bought a mouse from an advertiser, they could ask us to show you an ad for a mousepad.
Preferences
We use cookies to remember your settings and preferences, like the language you prefer and your privacy settings.
Cookies let you log in and out of the App.
Security
Cookies are just one way we protect you from security risks. For example, we use them to detect when someone might be trying to hack your Account or spam the community.
Analytics
We use cookies to make the App better. For example, these cookies tell us how many people use a certain feature and how popular it is, or whether people open an email we send.
We also use cookies to help advertisers understand who sees and interacts with their ads, and who visits their website or purchases their products.
Service providers
Sometimes we hire security vendors or use third-party analytics providers to help us understand how people are using our App. Just like we do, these providers may use cookies.

We also use them on the websites of partners who use our features like community feed.

There are a few ways you can choose how cookies are used on the App:
1. In the Personalization section of your settings, you can decide whether we use info from our partners and other services to customize the App for you.

Disclose your billing practices
If you charge users on a recurring basis, be transparent with them and disclose the terms of payment.
Stick to one advertiser per account, and be clear about who's advertising
We want people on the App to understand who's promoting content. You can't manage more than one advertiser through a single account or change the advertiser on an account. You also can't create profiles for someone else (for example, if you're an agency) and promote stuff from those profiles. Instead, you can help someone else promote ads from their own accounts.
If you charge users on a recurring basis, be transparent with them and disclose the terms of payment.
Respect the right of the others
Your ads can't infringe upon or violate the rights of any third party, including copyright, trademark or privacy rights.
Be respectful with your targeting
Make sure your targeting is relevant and follow all the below guidelines.
Don't target sensitive categories
Targeting certain audiences can be inappropriate and offensive. It's never okay to target people in a way that implies you're aware of sensitive info about them. You can't target any audience based on:
- Sensitive health or medical condition
- Race, color or ethnic origin
- Negative financial status or condition
- Religious or philosophical affiliation or beliefs
- Sexual behavior or orientation
- Alleged or actual commission of a crime
- Additionally, you can’t target ads to minors
- Trade union membership or affiliation
- Political affiliation
Be careful with any data usage
Anywhere you collect data used with ads, you must disclose and get legally-required consent from each individual for that data collection, sharing and use. If it’s the case you must tell your website and app visitors that their information will be shared with third parties for online behavioral advertising and that they can opt-out of online behavioral advertising through Gamebay App settings.
Don’t give us information that relates to sensitive categories - like a medical condition or ethnic origin—or that’s collected from a child-directed site or app, or from anyone who’s under 16 or the legal age of consent in your country.
Respect our community's data and privacy
You can't:
- Use data you receive from our ads service for any purpose (including audience targeting or user profiling) other than to understand your Gamebay campaigns, and only on an anonymous basis.
- Share data from our ads service with a third party, including another advertising service.
- Join data from our ads service with personally identifiable information (like an email address) or information that identifies a user, browser, or device (like a cookie or mobile ad identifier)
If you receive any data from Gamebay tied to a unique identifier (e.g., campaign reporting data linked to a mobile device ID) then you can’t use it to market products or services, or for any purpose besides measuring Gamebay campaigns, and you must delete it no later than 6 months after receiving it.
Be thoughtful with your editorial
To keep ads inspiring and actionable, we set high standards for the editorial quality of ads on the App.
Professional and neatly edited images
Ads should adhere to the highest levels of editorial quality. We don’t allow ads with:
- Fuzzy or grainy images
- Incorrectly oriented images (upside down or sideways)
- Poorly edited images or poorly cropped images
- Overly busy images that are packed with text overlay or have too many font styles and colors (try no more than 4 frames and 2 font styles or colors)
- Images with artificial functionality like a play or download buttons, notification icons, search bars, or elements that mimic Apps features
Improper grammar, incorrect spelling or excessive capitalization and symbols
- Low-quality user-generated content like selfies and screenshots
Quality landing pages
We care about the ad experience from start to finish - including the URL your ad links to. We want to make sure users find what they're looking for when they click through. We don’t allow landing pages to:
- Require people to take an action (like signing up) before they can see certain content unless your ad makes it clear that this is required
- Have pop-up ads or start automatic downloads on someone’s device
- Force people to visit another page
- Contain primarily advertising content (made-for-ads sites)
Create a consistent experience
Your ads must reflect who you are and what you're promoting, so make sure your ad image, description and landing page are consistent. Your ads can't suggest or imply that a product is available on your landing page if you don't actually offer that product.
Be responsible with your content
We don’t allow certain categories of advertising and restrict others. As always, you're responsible for the content you promote on the App, as well as the safety and trustworthiness of the products and services you offer.
Restricted content guidelines
Alcohol
We allow advertising of alcohol, including beer, wine, spirits, liqueurs, and alcohol memberships.
In all cases, you're responsible for complying with applicable federal and local laws and regulatory guidelines, including age gating where necessary. If a country you are based in or a country you target audience isn’t allowing Alcohol ads then it’s not permitted to advertise it.

Healthcare products and services
We don’t allow the advertising of healthcare products and services except:
